How to Name a Business: 7 Steps, 5 Tests and a Worked Example
To name a business, write down your buyer and your promise, build a long list, and cut it with five tests: can people say it, spell it, grow with it, tell it from your rivals, and read the right promise in it. Then clear the survivors with the state, the USPTO, a web search, the domain and the social handles. Test the last two or three on buyers, and register the winner the same week.
- Write down what the name has to carry.
- Build a long list.
- Cut it to a shortlist with the five tests.
- Cut every candidate that shares a core word with a local rival.
- Clear the rest in order: state records, the USPTO, the open web, the domain, the handles.
- Test the last two or three on buyers.
- Decide first; finish all filings and purchases within one week.
In short
State approval of your name is not trademark clearance.1 The name generator lists raw candidates with domain checks.
What makes a good business name: five tests
Each test is pass or fail; one fail cuts the candidate.
- Say it once. Say the name to someone once and ask them to repeat it. A hesitation or a changed sound fails it.
- Spell it from hearing. Say it on a call and ask the listener to type the domain. Digits and hyphens fail; so does Flickr’s dropped letter. Also read the initials (our illustration: Grand Old Oak Furniture spells GOOF) and the lowercase domain form.
- Room to grow. It fits the next three things you could sell and the next town you could open in. «Plano Baby Clothes» fails the day you add strollers or open in Frisco.
- Stands apart. It shares no core word with a direct rival (step 4).
- Signals the right promise. What a buyer reads into it matches what that buyer wants. A name that reads as luxury fails when your buyers’ first complaint is price.
Decide early between a descriptive and a distinctive name. «Plano Kids Resale» says what you sell, but the USPTO can refuse to register a mark that merely describes the goods or services it names.2 An invented word needs a tagline and avoids that refusal. Choose descriptive if you will stay one shop in one town; choose distinctive for any growth beyond that, including a registered mark.
How to name a business in 7 steps
Each step only removes candidates; none adds them back.
1. Write down what the name has to carry
Write down who you sell to and the problem you solve (your positioning); then add why you, from your story or place. Then add the next three things you could sell and the next town you could open in; test 3 reads them. If you have nothing to name yet, start with business ideas.
2. Build a long list
Collect words from four sources: what you sell (consign, closet), what the buyer gets (savings, a fresh start), your story and place (a street, a landmark), and tone words (playful, plain). Combine them six ways. Our unchecked illustrations: descriptive (Plano Kids Resale), compound (Closet Swap), blend (Kidonomy), altered word (Swapr, which fails test 2), metaphor (Growth Spurt), founder’s name (Smith Kids Resale).
List about 30 candidates, our rule of thumb, before you judge any.
3. Cut it to a shortlist with the five tests
Run every candidate through the tests in order and stop at the first fail. Keep three to five (an assumption: our rule of thumb). If fewer than three survive, go back to step 2 with the words that passed.
4. Test the shortlist against your local rivals
Search the way a buyer would, your town plus what you sell, and list your direct competitors. For each rival’s name, drop the town tag and the legal ending and underline the core words left. Cut every candidate that shares one, starting with words of the most visible rival. A candidate that echoes the leader sends its word of mouth to the leader. No rival list yet? See who already holds your local field: the idea check lists the direct rivals with their share of search visibility.
5. Clear the name in five places, in this order
Legal registers go first: a legal conflict costs the most to fix later. Stop at the first hard fail.
| register | how to search | «clear» does not prove |
|---|---|---|
| State entity records | your Secretary of State’s name search | trademark rights1 |
| USPTO | the word and its sound-alikes, in your class of goods | that nobody uses it unregistered |
| Open web, maps, directories | the name plus your trade, nearby | anything about the other registers |
| Domain | the .com and one fallback | anything legal |
| Social handles | each network you will use | that it stays free until you claim it |
«Similar» is wider than «identical». The USPTO refuses a mark likely to be confused with a registered one; it weighs mainly how similar the marks are and how related the goods or services are.3 A search for «Kidz Kloset» covers «Kids Closet» too.
Unregistered use counts: US trademark rights come from use in commerce, so a shop already trading under a similar name can block yours in its area.4 Copyright does not protect names, titles, slogans or short phrases; some names may be protected under trademark law instead.5
Fit the handle to X, the strictest: at most 156 characters, only letters, numbers and underscores.
If the name is taken, change the core word: small add-ons like a hyphen still sound like the original. A search reserves nothing; step 7 holds the name.
6. Test the last two or three on buyers
Ask at least five buyers outside family and friends (an assumption: our minimum). Say the name once, then ask:
- What does this business sell?
- How would you spell it?
- What would you expect to pay there?
If you have to explain the name first, cut it. See these questions to ask buyers. To test with clicks, put the two finalists on two pages in a demand test or run a fake door test.
Test before you announce. In 2019 Kim Kardashian announced her shapewear line as «Kimono» and, after accusations of cultural appropriation, renamed it SKIMS in August 2019, before its launch.7
7. Decide, then lock the name in
Give the decision two weeks from the shortlist (an assumption: our rule). Then, in one week:
- File the entity or reserve its name. In Texas, Form 501 reserves a name with the Secretary of State for 120 days8 for $408. A Texas LLC name must contain «limited liability company», «limited company» or an abbreviation of either.9
- Buy the domain and claim the handles; if the brand differs from the legal name, file an assumed name (DBA). Texas sends an LLC or corporation to the Secretary of State and a sole proprietor to the county clerk where the business operates; the filing gives no exclusive right to the name.10
- Decide on federal registration: since January 18, 2025, the USPTO base filing fee is $35011 per class of goods or services.
Forming the company is covered in how to start a business.
Naming the business after yourself
Your own name fits when clients buy your skill, as with a lawyer or tutor. It costs you when you sell the business, since the buyer gets a name tied to someone who leaves, and when you hire, since clients ask for you instead of the person you sent. If your full name is taken, add a middle initial before you add a word.
How to use a business name generator
A generator fills step 2. Give it what you sell and what the buyer gets, plus a tone word; below, that is consigned kids’ gear that saves parents money on name brands, in a friendly tone. Treat the output as long-list material. Our business name generator returns names with their free domains, so register 4 is done; the other four still wait.
Example: naming a kids’ consignment shop in Plano, Texas
The idea comes from a real system check of October 15, 2026 (example by our method): «Upscale kids’ consignment thrift shop in a Plano, Texas retail suite: parents selling outgrown clothes, toys and strollers for a split, buyers saving on name brands».ex The check ran 17ex searches over 27ex sources and returned «Possible, with caveats»ex with a score of 53ex, so the idea is worth naming.
The check found 10ex direct competitors (example by our method). The five most visible, as the check lists them:
| rival | visibility share, % | core words |
|---|---|---|
| Divine Consign Plano | 38ex | Divine, Consign |
| Once Upon A Child Plano | 28ex | Child |
| Kid to Kid Allen | 8ex | Kid |
| Just Between Friends Plano | 8ex | Friends |
| Rhea Lana’s Frisco | 5ex | a person’s name |
Our reading of the check’s data:
- As the check lists them, every name carries a town, which may not be part of its legal name.
- The top two hold 66%exex of the visibility (example by our method: our sum of 38 and 28). A name built on Kid or Consign blurs into them.
- The check’s first risk: «Divine Consign Plano already serves the same parents in Plano and may take most of the local demand.»ex The field test cuts «Consign» first.
- Price leads the complaint themes with 6ex, then Other with 2ex and Reliability and trust with 1ex (example by our method). Price is the signal for test 5.
- The demand source is noneex, and a risk reads: «There is no search-volume data for this market, so demand size in Plano is unverified.»ex Nothing supports a search-phrase name like «Plano kids consignment».
Our candidates (example by our method; each a candidate, not cleared):
- «Kids Consign Plano» fails test 3 (a town) and test 4 (Kid, Consign).
- «Hand-Me-Up» fails test 2: a hyphen, and several spellings by ear.
- «Little Luxe Resale» fails test 5: «Luxe» promises prices the top complaint pushes against.
- «Next Size Up» passes 1, 2, 4 and 5; test 3 is the founder’s call, since it fits clothes better than strollers.
- «Outgrown» passes all five on paper.
The last two make the shortlist; «Outgrown» goes to step 5 first, since a common word is the most likely to be taken. Check your own idea the same way before you name.
Naming mistakes that force a rename
- Taking state approval as clearance against trademarks.1
- Counting on copyright, which does not cover names.5
- Adding a keyword or town to your map listing. Google Business Profile guidelines require the profile’s name to match the business’s real-world name and do not permit added keywords or a location that are not part of it.12
- Ordering signs before step 7. «Plano Baby Threads» (our illustration) needs new signs and a new domain the day it adds toys.
FAQ
If the state accepted my LLC name, can someone still stop me from using it?
Can you copyright a business name?
No. Copyright does not protect names; some names may be protected as trademarks.5
Do I need to trademark my business name?
Should my business name include my city or a keyword?
Only if you will never sell beyond that city or product (test 3). In the example, three of five top rivals carry «Plano». Your Business Profile cannot add a town or keyword that is not in your real name.12
What if the .com is taken?
Change the core word first; small add-ons like a hyphen or a town tag fail tests 2 to 4. Pay the owner only if no shortlisted name is free.
Is a DBA the same as registering a business name?
No. An assumed name lets you trade under a brand that differs from your legal name; in Texas it gives no exclusive right to it.10
Start your long list, then cut it with the five tests.
